Welcome to TalabaDZ! These Terms of Use ("Terms") govern your access to and use of the TalabaDZ mobile application, website, and related services (collectively, the "Platform"). By accessing or using our Platform, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, please do not use the Platform.
1. Description of Service
TalabaDZ is an educational platform designed for university students in Algeria. We provide tools for academic planning, course material sharing, real-time communication (chat), and community interaction.
2. User Accounts and Registration
To access certain features of the Platform, you must register for an account.
- Accuracy: You agree to provide accurate, current, and complete information during the registration process.
- Security: You are responsible for safeguarding your password and for any activities or actions under your account. You agree to notify us immediately of any unauthorized use of your account.
- Eligibility: You must be at least 13 years old to use the Platform. By using the Platform, you represent and warrant that you meet this requirement.
3. User-Generated Content (UGC)
Our Platform allows you to post, link, store, share, and otherwise make available certain information, text, graphics, files, or other material ("Content").
- Ownership: You retain any and all of your rights to any Content you submit, post or display on or through the Platform and you are responsible for protecting those rights.
- License to Us: By posting Content on the Platform, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Platform. This license is necessary for us to operate the platform and share course materials with other students.
- Prohibited Content: You agree not to post Content that:
- Is unlawful, defamatory, libelous, threatening, pornographic, harassing, hateful, or encourages criminal conduct.
- Violates or infringes upon the intellectual property rights of others (e.g., sharing copyrighted textbooks without permission).
- Contains malicious code, viruses, or any other destructive elements.
- Promotes academic dishonesty, such as sharing answers to live exams.
4. Acceptable Use and Conduct
You agree to use the Platform only for lawful purposes. You agree not to take any action that might compromise the security of the Platform, render the Platform inaccessible to others, or otherwise cause damage to the Platform or the Content.
- No Spamming: You may not use the Platform to transmit any unsolicited advertising, promotional materials, "junk mail," "spam," or any other form of solicitation.
- Respect Others: Harassment, bullying, or abusive behavior in chat rooms or community forums is strictly prohibited.
5. Intellectual Property Rights (Platform)
The Platform and its original content (excluding User-Generated Content), features, and functionality are and will remain the exclusive property of TalabaDZ and its licensors. The Platform is protected by copyright, trademark, and other laws of the People's Democratic Republic of Algeria and foreign countries.
6. Termination and Account Suspension
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the Platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the Platform or delete your account through the app settings.
7. Disclaimers
Your use of the Platform is at your sole risk. The Platform is provided on an "AS IS" and "AS AVAILABLE" basis.
- Educational Material: We do not guarantee the accuracy, completeness, or usefulness of any course materials or academic information provided on the Platform. Users are responsible for verifying any academic information.
- No Warranties: We explicitly disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
In no event shall TalabaDZ, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Platform.
- Any conduct or content of any third party on the Platform.
- Any content obtained from the Platform.
- Unauthorized access, use, or alteration of your transmissions or content.
9. Governing Law & Jurisdiction
These Terms shall be governed and construed in accordance with the laws of the People's Democratic Republic of Algeria, without regard to its conflict of law provisions. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the Algerian courts.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any significant changes by posting the new Terms on the Platform and updating the "Last Updated" date. By continuing to access or use our Platform after those revisions become effective, you agree to be bound by the revised terms.
